1. Agreement to Terms

Welcome to Living Stones (“Company,” “we,” “us,” or “our”). These Terms of Service (“Terms”) constitute a legally binding agreement between you (“User,” “you,” or “your”) and Eben Labs, Inc., a Delaware C Corporation doing business as Living Stones, located at 110 Primera Dr, San Antonio, TX 78212.

By accessing, downloading, installing, or using the Living Stones mobile application and associated web services (collectively, the “Service”), you agree to be bound by these Terms. If you do not agree to any part of these Terms, you may not use the Service.

We also maintain a Privacy Policy at livingstones.app/privacy-policy, which governs how we collect, use, and disclose your personal information. Please review it carefully.

2. Description of Services

Living Stones is a social platform designed for Christians to capture, share, and reflect on spiritual moments. The Service includes the following core features:

Stones: Journal entries where you record and reflect on moments when you see God moving in your life (“Ebenezer moments”).
Tribes: Communities and groups within the platform where users gather to share, discuss, and support one another.
Organizations: A higher-level grouping that brings one or more Tribes together under a shared identity, such as a church, ministry, school, or workplace network.
Comments: The ability to comment on and engage with other users’ Stones.
Content Sharing: Features to share Stones and reflections with other users or within Tribes.
AI-Powered Reflections: Personalized insights and reflections on user content generated by artificial intelligence, intended to enhance your spiritual journey and deepen reflection.

The Service is currently provided free of charge. Future versions may include paid features or premium tiers. See Section 20 for details.

3. User Accounts

3.1 Registration and Account Responsibility

To use certain features of the Service, you must create an account by providing accurate, complete, and current information. You are responsible for maintaining the confidentiality of your account credentials (including passwords) and for all activity that occurs under your account. You agree to provide truthful and accurate information, keep it current, immediately notify us of any unauthorized access or security breach, and accept full responsibility for all activities under your account.

3.2 Account Security

While we employ industry-standard security measures to protect your account, we cannot guarantee absolute security. You acknowledge that you are responsible for maintaining the security of your credentials. Living Stones is not liable for unauthorized access resulting from your failure to safeguard your password or account information.

4. Age Requirements

The Service is intended for users aged 13 and older. By registering, you represent and warrant that you are at least 13 years of age. If you are a parent or guardian and believe a child under 13 has registered for the Service without your consent, please contact us immediately at support@livingstones.app.

Living Stones complies with the Children’s Online Privacy Protection Act (COPPA). We do not knowingly collect personal information from children under 13. If we learn that we have collected personal information from a child under 13 without parental consent, we will promptly delete such information and terminate the child’s account.

5. User Content

5.1 Ownership and Responsibility

You retain all ownership rights to any content you create and post on Living Stones, including Stones, comments, and other materials (“User Content”). You are solely responsible for the accuracy, legality, and appropriateness of all User Content you provide.

5.2 License Grant to Living Stones

By posting User Content to the Service, you grant Living Stones a non-exclusive, royalty-free, worldwide, perpetual, and irrevocable license to display, reproduce, and distribute your User Content within the Service; process your User Content through artificial intelligence systems to generate personalized reflections, insights, and recommendations; modify your User Content as necessary to comply with platform guidelines or applicable law; and use aggregate or anonymized data derived from your User Content for analytics, platform improvement, and research purposes.

5.3 AI Processing Disclosure

You acknowledge and consent that User Content may be processed by artificial intelligence systems to generate personalized reflections and insights, such as monthly recaps. These features are provided through Google Cloud Vertex AI, using language models developed by Google or Anthropic. This processing may analyze the content, context, and themes of your Stones and Reflections. In addition, content you share to a Tribe or Organization may be analyzed in aggregate — together with content shared by other members of that community — to surface community-level themes for members of that community. Community insights are designed to present themes and totals only, and never to quote, name, or attribute your content to you individually. 5.4 User Content Guidelines

You agree that User Content will not contain content that is illegal, defamatory, obscene, hateful, or violates any third-party rights. Prohibited content includes but is not limited to hate speech, harassment, graphic violence, and sexually explicit material.

6. Acceptable Use Policy

You agree to use the Service only for lawful purposes and in a manner that does not infringe upon the rights of others or restrict their use and enjoyment of the Service. Prohibited behaviors include:

Harassment, bullying, or threatening any user or group.
Posting or promoting hate speech, discrimination, or bigotry based on race, ethnicity, religion, gender, sexual orientation, or other protected characteristics.
Sharing spam, malware, viruses, or any code designed to harm or interfere with the Service.
Engaging in illegal activities or soliciting others to do so.
Impersonating another person or entity.
Violating intellectual property rights.
Attempting to gain unauthorized access to the Service, other users’ accounts, or Living Stones’ systems.
Posting sexually explicit material or child sexual abuse material.
Selling, trading, or transferring your account to another person.
Using automated tools, bots, or scrapers to collect data or access the Service without permission.

Living Stones reserves the right to remove User Content that violates this policy and may suspend or terminate your account for repeated violations.

7. Content Moderation and Enforcement

7.1 User Reporting

Living Stones provides users with tools to report User Content that they believe violates these Terms, our Acceptable Use Policy, or applicable law. Reports may be submitted through the in-app reporting feature or by contacting us at support@livingstones.app. We review reports in good faith and will take action as we deem appropriate, but we do not guarantee that all reported content will be removed.

7.2 Living Stones’ Right to Moderate Content

Living Stones reserves the right, but not the obligation, to review, monitor, edit, remove, or disable access to any User Content at any time, with or without notice, and for any reason, including content that violates these Terms or applicable law, content reported by other users, content that poses a risk to the platform or its users, and content that infringes third-party rights. Living Stones acts as a platform and not as a publisher of User Content.

7.3 Enforcement Actions

Upon determining that User Content or user behavior violates these Terms, Living Stones may, in our sole discretion: remove content; issue a formal warning; temporarily suspend access; permanently ban the account for serious, repeated, or egregious violations; or refer conduct to law enforcement or pursue civil legal remedies where warranted.

7.4 Repeat Violations

Living Stones maintains a zero-tolerance policy toward repeated violations of these Terms. Users who repeatedly violate these Terms or our Acceptable Use Policy may be permanently banned from the Service at Living Stones’ sole discretion.

7.5 Appeals

If you believe that moderation action has been taken against your content or account in error, you may submit an appeal by contacting us at support@livingstones.app within 30 days of the action. Appeals are reviewed at Living Stones’ sole discretion, and our determination on any appeal shall be final.

7.6 No Liability for Moderation Decisions

Living Stones shall not be liable to you or any third party for any moderation decision, including the removal of User Content or the suspension or termination of your account.

8. Tribes, Organizations, and Community Guidelines

8.1 Tribes

Tribes are user-created or officially managed communities. Each Tribe may have its own guidelines and is managed by its owner(s). You agree to respect the rules of any Tribe you join, abide by the decisions of Tribe owners, and accept that Tribe owners may remove content or suspend membership based on Tribe-specific policies. Living Stones maintains the right to intervene in any Tribe if content or conduct violates these Terms or applicable law.

8.2 Organizations

Organizations are a higher-level grouping that brings one or more Tribes together under a shared name, description, and logo (for example, a church, ministry, school, or workplace network). An Organization is created and managed by its owner (the “Organization Admin”). Organizations are invite-only: a Tribe becomes part of an Organization when that Tribe’s owner links it using the Organization’s join code, and there is no public directory or search. Your membership in an Organization is derived from your membership in a Tribe linked to it.

Living Stones does not own, operate, or endorse user-created Organizations and is not responsible for the conduct of an Organization, its Admin, or its linked Tribes, except where we have expressly assumed that responsibility. All content shared within an Organization or its Tribes remains subject to the same content standards, license, and moderation rules set out in these Terms.

9. AI-Generated Content

Living Stones uses artificial intelligence to generate personalized reflections and insights based on your User Content. You acknowledge and agree that:

AI-generated reflections are computational interpretations designed to enhance your personal reflection and are not theological or pastoral advice.
AI-generated content should not replace consultation with qualified spiritual leaders, counselors, therapists, or mental health professionals.
Living Stones makes no representations regarding the accuracy, completeness, or suitability of AI-generated content for your specific spiritual or personal journey.
AI systems may make errors or produce unexpected output; you are responsible for critically evaluating any AI-generated content.
AI-generated content is provided “as-is” without warranty of any kind.

Important: If you are experiencing a mental health crisis, spiritual distress, or suicidal thoughts, please seek help from a qualified professional or crisis service immediately. Do not rely solely on AI-generated content for support in these situations.

10. Intellectual Property

Living Stones owns and retains all rights, title, and interest in the Service, including the software, code, design, graphics, layout, and functionality; the “Living Stones” name, logo, and all associated trademarks; all documentation and materials created by Living Stones (excluding User Content); and any improvements or modifications to the Service.

You are granted a limited, non-exclusive, non-transferable license to use the Service in accordance with these Terms. This license does not permit you to reverse-engineer, decompile, or disassemble the Service; remove or alter any proprietary notices; republish, reproduce, or distribute the Service or its components; or use the Service to create a competing product or service.

11. Third-Party Services

Living Stones relies on third-party services to provide functionality, including Firebase (cloud infrastructure for authentication, database, and push notifications), OpenAI and Anthropic (AI providers for generating reflections and insights), Airbridge (analytics and attribution tracking), and other third-party APIs and services as may be integrated from time to time. Your use of these third-party services is governed by their respective terms of service and privacy policies. Living Stones is not responsible for the conduct, policies, or performance of third-party providers.

12. Termination

12.1 Termination by You

You may terminate your account and cease using the Service at any time by following the account deletion instructions in the app or contacting support@livingstones.app.

12.2 Termination by Living Stones

Living Stones may suspend, restrict, or terminate your account and access to the Service at any time, without notice and without cause, though we will typically provide notice when circumstances permit, including if you violate these Terms or any applicable law, engage in conduct harmful to the Service or other users, or if we cease operating the Service in your region.

12.3 Effect of Termination

Upon termination, your right to use the Service ceases immediately. Your User Content may be deleted from our servers unless we are required to retain it by law. You remain liable for any obligations incurred during your use of the Service.

13. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. LIVING STONES DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND TITLE. Living Stones does not warrant that the Service will be uninterrupted, secure, or error-free; that defects will be corrected; that the Service will meet your expectations; or that User Content or integrated third-party services will be accurate or function without disruption.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LIVING STONES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Living Stones’ total liability to you for any claim arising out of or relating to these Terms or the Service shall not exceed the amount you paid to Living Stones in the 12 months preceding the claim (or $100, whichever is greater, if no payment was made). Some jurisdictions do not allow the exclusion or limitation of liability, so the preceding limitation shall apply to the maximum extent allowed by law.

15. Indemnification

You agree to indemnify, defend, and hold harmless Living Stones, its officers, directors, employees, agents, and successors from any and all claims, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or relating to your use of the Service or violation of these Terms; your User Content or conduct on the platform; your infringement or violation of any third-party rights; and any harm caused by content you post.

16. Dispute Resolution and Arbitration

16.1 Binding Arbitration

You and Living Stones agree that any dispute, claim, or controversy arising out of or relating to these Terms, the Service, or your use thereof shall be resolved by binding arbitration administered by JAMS under its Streamlined Arbitration Rules & Procedures, or if JAMS is unavailable, by the American Arbitration Association (AAA) under its Commercial Arbitration Rules.

16.2 Class Action Waiver

YOU AND LIVING STONES AGREE THAT ANY PROCEEDING SHALL BE CONDUCTED ON AN INDIVIDUAL BASIS ONLY AND NOT AS A CLASS ACTION, COLLECTIVE ACTION, OR REPRESENTATIVE ACTION. You waive your right to participate in class actions, class arbitrations, or representative actions against Living Stones.

16.3 Small Claims Exception

Notwithstanding the above, either you or Living Stones may pursue a claim in small claims court if the claim qualifies for that court’s jurisdiction and is pursued on an individual (non-class) basis.

16.4 Arbitration Procedures

The arbitration shall be conducted in English; each party shall bear its own attorneys’ fees and costs, except as provided by law or the arbitration rules; the arbitration shall take place in San Antonio, Texas, unless the parties agree otherwise; and the arbitrator shall issue a written decision.

16.5 Opt-Out

If you do not wish to be bound by arbitration, you may opt out by sending written notice to Living Stones at support@livingstones.app within 30 days of first accepting these Terms. Your notice must include your name, email address, and a clear statement that you wish to opt out of arbitration.

17. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law principles. You agree to submit to the exclusive jurisdiction of the state and federal courts located in San Antonio, Texas for any disputes not subject to arbitration.

18. Changes to Terms

Living Stones reserves the right to modify these Terms at any time. Changes will be effective upon posting to the Service or by sending notice to your registered email address. Your continued use of the Service after such modifications constitutes acceptance of the updated Terms. If you do not agree to the modified Terms, you must cease using the Service and delete your account.

19. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be severed, and the remaining provisions shall remain in full force and effect to the maximum extent permitted by law.

20. Subscriptions and Paid Features

Living Stones Plus. Living Stones offers an optional paid subscription, “Living Stones Plus,” that unlocks additional features. Plus is available as a monthly or annual plan at the price shown in the app at the time of purchase. New subscribers may be offered a free trial; the length and availability of any free trial are shown before you subscribe.

Free trial. Where offered, a free trial is available only once per App Store or Google Play account. If you have previously subscribed, you may not be eligible for another free trial. Unless you cancel at least 24 hours before the trial ends, your trial automatically converts to a paid subscription and you will be charged.

Billing and automatic renewal. All purchases are processed by the Apple App Store or Google Play, not by Living Stones directly. Payment is charged to your App Store or Google Play account at confirmation of purchase. Subscriptions renew automatically for the same period and price until you cancel. Your account is charged for each renewal within the 24-hour period before the current period ends.

Managing and canceling. You can manage or cancel your subscription at any time through your App Store or Google Play account settings. Cancellation takes effect at the end of the current billing period; you retain access to Plus until then. Uninstalling the app does not cancel your subscription.

Price changes. We may change subscription prices. Any change applies to future billing periods only, and where required we will give you advance notice and the opportunity to cancel before the change takes effect.

Refunds. Refunds are handled by the Apple App Store or Google Play in accordance with their policies. Please direct refund requests to the applicable store; Living Stones cannot issue store refunds directly.

Gifting. A Plus subscriber may be able to give a free trial of Plus to another member of one of their Tribes. Gifted trials are subject to the same eligibility rules above and confer no additional rights.

If your subscription ends. If your subscription lapses or you cancel, your content — including your Stones, drafts, tags, favorites, and any photos or videos you have added — is retained, not deleted. However, access to Plus-only features and the content held within them (for example, opening your Drafts or using your custom Tags) is paused until you subscribe again. Resubscribing restores access to everything, just as you left it.
